IS YOUR KARAOKE
Copyright and trademark law are serious matters, and if your business isn't in compliance, you could face steep fines, confiscation of property, or even jail time.
WHY YOU MUST BE SURE
Ignorance of the law won't get you any slack
You or your KJ may be infringing, and you might never know it until you are served with a lawsuit (or the Federal Marshalls show up at your business). KJ's play music from many different sources, and it's not always obvious which ones are legal and which aren't. When push comes to shove, and you're found liable, don't expect "But Your Honor, I didn't realize this was illegal," to lessen your fine, or jail time.
Penalties for copyright and trademark violation are severe
If you break copyright law, you could be subject to both civil and criminal penalties. Statutory damages start at $750 and go up to $30,000 per work infringed. If the infringement is judged to be "willful" then penalties rise to a maximum of $150,000 per work infringed. If you're found guilty of criminal infringement, you can face years of jail time, and fines of up to $250,000 per offense.
You need a simple solution to get and stay legal
Venue owners and operators can be just as liable as KJs
If your venue is playing illegal karaoke and you benefit from it in some way (charging for food, drinks or cover) then you could be liable under the law. "Vicarious liability" occurs when the venue's agent, such as the KJ they hired, violates the law, when the venue manager or owner had control over the premises (such as a door lock where only management had the keys) and benefitted from the infringement in some way.
Copyright law is complex, and only specialized lawyers have the time and money to become experts on it. There are a lot of interests involved: those of the songwriters, the publishers, the karaoke label, the distribution service, the KJ and the venue owner. Sorting them out is hard enough for the experts. That's why we invented a bulletproof solution to help you get and stay legal.
It doesn't have to be hard. You can report piracy, view our list of vetted KJs, and find a legal solution that fits you and your budget.
